Acceptance of Terms

These Terms of Use govern your use of the Fédération Québécoise des Clubs Quads (FQCQ) website, hereinafter referred to as “the Site”. By accessing or using this Site, you acknowledge that you have read, understood and agree to be bound by these Terms of Use, and you accept the Terms of Use in their entirety, for your personal, non-commercial use. If you do not agree to these terms, please do not use the Site.

Modifications to conditions

The FQCQ reserves the right to modify these Terms of Use at any time without notice. It is your responsibility to check this page regularly for any changes. Your continued use of the Site following the posting of changes constitutes your acceptance of those changes.

Modification of the Site, services and products offered

The FQCQ reserves the right, at its sole discretion, to modify the Site or any part thereof at any time, to suspend or modify it, or to withdraw the services or products offered, without further notice or delay. The FQCQ shall not be liable to any person for any loss or damage arising directly or indirectly from any such modification of the Site.

Use of the Site

a) You agree to use the Site in accordance with all applicable laws and regulations.

b) You are responsible for maintaining the confidentiality of your account, if any, and all activities associated therewith.

c) You agree not to use the Site to post, upload or transmit any unlawful, harmful, threatening, abusive, libelous, defamatory, obscene, vulgar or other material that QFCF deems inappropriate.

d) You agree not to disrupt or damage the operation of the Site, the servers or the network associated with it, or to violate the security measures in place.

Intellectual property rights

a) The Site and its contents, including but not limited to text, graphics, logos, images, videos, sounds, software and icons, are the exclusive property of the FQCQ or its partners, and are protected by intellectual property laws.

b) You may not reproduce, distribute, modify, display, transmit, publish, sell or exploit in any way any content of the Site, in whole or in part, without the prior written permission of the FQCQ.

Links to third-party sites

The Site may contain links to third-party websites. These links are provided solely for your convenience. The FQCQ has no control over these third-party sites and assumes no responsibility for their content. Access to such sites is at your own risk.

Limitation of liability

To the fullest extent permitted by applicable law, the FQCQ disclaims all liability arising from your use of the Site. In no event will the FQCQ be liable for any direct, indirect, special, consequential or punitive damages, including, without limitation, loss of profits, revenue, data or use, arising out of or in connection with the use of or inability to use the Site.

Risks associated with Internet use

Errors, interruptions and viruses: The Site is accessible subject to availability. While the FQCQ uses reasonable efforts to keep the Site free of errors, interruptions and viruses, the FQCQ makes no warranty, express or implied, that the Site will be uninterrupted, timely, secure or free of viruses or errors, that the information presented on the Site is accurate or error-free, or that defects in software or applications, if any, will be corrected. You will be solely responsible for any damage to your computer or loss of data that results from downloading any materials.

User code, password and security: Where applicable, although efforts are made by the FQCQ to ensure that no third party will consult or obtain personal information concerning you through its Site, complete confidentiality and security are not currently guaranteed on the Internet. Communications via the Internet are subject to interception, loss or alteration. You acknowledge and agree that the FQCQ will not be liable for any damages resulting from the transmission of confidential or personal information over the Internet and that such communications are at your own risk. You are solely responsible for maintaining the confidentiality of your username and password and for all actions taken under your identification. You are responsible for notifying the FQCQ immediately of any unauthorized use of your username and password or any other breach of security, and for taking all reasonable precautions to ensure the security of your use of the Site. The FQCQ may cancel or suspend your account, at its discretion, without incurring any liability whatsoever.

Intellectual property rights

All content on this Site, including text, logos, slogans, designs, graphics, images, photographs, videos, musical excerpts, downloads, technology programs and business processes, is the exclusive property of the FQCQ. The FQCQ makes no representation or warranty that any content downloaded from this Site does not infringe the rights of any third party. All content on this Site is subject to the FQCQ’s intellectual property rights and the Copyright Act of Canada. Any unauthorized use of this content, including any reproduction, distribution or redistribution, transmission or retransmission, communication to the public by telecommunication, performance, translation, making available to the public or any downloading is prohibited without the prior written consent of the FQCQ.

Site security

You may not use the Site for any purpose other than as provided herein. You may not attempt in any manner whatsoever to access any information not intended for you or to test the vulnerability of our systems and solutions, compromise their security or effectiveness or send unsolicited e-mail including, without limitation, advertising. All such actions are against the law and may result in civil or criminal prosecution.

Other terms of use

You may be subject to additional terms of use specific to certain programs, offers, promotions, sweepstakes, services, social media, third-party content and third-party software, which will be communicated to you when you access such programs, offers, promotions, services, social media platforms, content or software.

Applicable law and jurisdiction

These Terms of Use are governed by the laws of the Province of Quebec, Canada. Any dispute arising from the use of the Site shall be submitted to the exclusive jurisdiction of the competent courts of the Province of Quebec.
